These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "customer") and Tuned Diesel Performance ("we," "us," "our," or the "Company"), concerning your access to and use of the Tuned Diesel Performance website as well as any related applications (the "Site").
By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access the Site or use our services.
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this Site.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws and emissions regulations).
All products and services offered on the Site are described to the best of our ability. We reserve the right to discontinue any product at any time. Prices for our products are subject to change without notice.

Our products are designed and intended solely for off-road, competition, or racing use only. It is illegal under federal law (including the U.S. Clean Air Act) and many state and provincial laws to modify, remove, or disable emissions-related components (including but not limited to DPF, EGR, SCR/AdBlue, O2 sensors, and catalytic converters) in a vehicle that is used on public roads. Deleting emissions components on a road-legal vehicle is prohibited. We do not condone or promote emissions deletion for on-road use and shall not be held responsible for how customers use our products.
Products are sold for off-road use only. By purchasing from us, you acknowledge that you have read, understood, and agree to the Off-Road Use Policy available on our Site.
By placing an order, you agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
All payments must be made at the time of order. We accept payment methods as listed on the Site. You agree to pay all charges incurred by you or on your behalf through the Site, at the prices in effect when such charges are incurred.
We will make reasonable efforts to ship products within the estimated timeframes. However, delivery dates are estimates only and are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier. See our Shipping & Freight page for details.
Please refer to our Return Policy posted on the Site for information about returns and refunds. Tuning services, digital products, and custom orders may be non-refundable once processed.

You agree to indemnify, defend, and hold harmless Tuned Diesel Performance and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Alberta, Canada for the resolution of any disputes arising under or in connection with these Terms.
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes.
